Privacy Notice for Recruitment Process (GDPR Compliance)

By clicking the “Apply” button, you consent to the processing of your personal data provided in the application documents by Fulfilio Sp. z o.o., based in Warsaw, for the purpose of the current recruitment process. This consent applies to additional personal data that is not explicitly required by the Labor Code or other applicable laws (e.g., your image, information about interests, etc.).
The controller of the personal data provided in your recruitment application and attached documents is Fulfilio Sp. z o.o., with its registered office at ul. Klimczaka 1, Warsaw (hereinafter referred to as the “Controller”).
For matters related to the processing of your personal data, you may contact the Data Protection Officer (DPO) appointed by the Controller via:

Your personal data will be processed by the Controller for the purpose of conducting the current recruitment process based on the following legal grounds:

Enabling participation in recruitment and candidate assessment under:

- Article 6(1)(b) of the GDPR, where data is necessary to take steps at the request of the data subject prior to entering into a contract.
- Article 6(1)(c) of the GDPR, where data processing is required by the Labor Code for employment-related purposes.

Processing of additional personal data (beyond legally required information, such as an image or interests):

- Article 6(1)(a) of the GDPR, where the Controller processes “regular” personal data voluntarily provided by the candidate beyond what is required by the Labor Code.
- Article 9(2)(a) of the GDPR, where the Controller processes “sensitive” data voluntarily provided by the candidate beyond what is required by the Labor Code.
- If you do not wish the Controller to process additional personal data about you, please do not include such information in your submitted documents. Furthermore, we request that you do not include personal data such as marital status, number of children, or health-related details. If such data is provided, the Controller will be obliged to delete it immediately.

Medical examination referrals and storage of medical certificates under:

- Article 9(2)(b) of the GDPR, where the Controller processes health-related data to facilitate the candidate’s mandatory medical examination and obtain a certificate confirming their ability to perform the job.

Establishing, exercising, or defending legal claims under:

- Article 6(1)(f) of the GDPR, where processing is necessary for the Controller’s legitimate interests in asserting or defending against legal claims.
Recipients of Your Data:
- IT system providers, job advertisement service providers, recruitment management system providers, and recruitment service providers, including:
  - Pro People Sp. z o.o., ul. Równoległa 4a, 02-235 Warsaw
  - eRecruitment Solutions Sp. z o.o., ul. Prosta 68, 00-838 Warsaw
- In certain cases, a client of Fulfilio Sp. z o.o. who has engaged Fulfilio Sp. z o.o. for services related to the role for which you are applying may also have access to your personal data in the event of employment.
Retention Period:
- Your personal data will be stored for six (6) months from the end of the recruitment process, if you have provided consent for participation in the current recruitment only.
Your Rights:
- You have the right to access, obtain a copy, rectify, erase, or restrict the processing of your personal data.
- You also have the right to object to processing based on the legitimate interest of the Controller and to data portability.
- To exercise these rights, please contact the Data Protection Officer (DPO) using the contact details provided in Section 3.
Right to Withdraw Consent:
- If your data is processed based on your consent (e.g., for data beyond what is required by the Labor Code), you have the right to withdraw consent at any time by sending a request to biuro@pro-people.pl.
- Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to Lodge a Complaint:
- If you believe that the processing of your personal data violates data protection laws, you have the right to lodge a complaint with the supervisory authority:

Automated Decision-Making and Profiling:

Your data will not be subject to automated decision-making or profiling.

International Data Transfers:

Your personal data is stored within the European Economic Area (EEA) by default.
Some IT infrastructure providers (e.g., Microsoft services) may access data remotely from third countries.
The European Commission has issued an adequacy decision regarding the United States for companies participating in the Data Privacy Framework. Fulfilio Sp. z o.o. cooperates only with companies that are part of this framework. More information is available at: https://www.dataprivacyframework.gov/s/.
In other cases, we apply Standard Contractual Clauses (SCCs), copies of which are available upon request.

Whistleblower Protection Policy:

Fulfilio Sp. z o.o. has implemented a Whistleblower Protection Policy. If you wish to report any legal violations, you may submit a report via the Whistleblower Form.
